General terms and conditions of TM Titres-Services sprl for one-off services

Article 1
- (planning@tmts.be ), one or more services of a minimum of 3 consecutive hours in service vouchers without this entailing a regular commitment. This request must be made at least 4 working days before the desired date of service. Outside this timeframe, the user can still make their one-off service request; however, TM Titres-Services cannot guarantee the presence of a domestic helper on the desired date. Furthermore, since all one-off services do not involve recurrence, TM Titres-Services cannot guarantee the availability of the same domestic helper for each service.
- home cleaning,
- ironing of household linen,
- minor occasional sewing work,
- minor household shopping,
- meal preparation
- cleaning of the windows of the home, not requiring climbing more than 2 steps.
Attention : window cleaning on balconies and terraces can only be done provided that feet remain on the ground !
Consequently, the following activities are prohibited :
- childcare or animal care,
- painting work,
- all gardening work,
- maintenance of common areas (apartment building stairwell, …)
- car cleaning and washing
- DIY work
- home care, patient care
- Cleaning up animal or human excrement,
- etc…

3. The user undertakes to provide the domestic helper with:
- In paper service vouchers: one service voucher (signed and dated) per hour
of work provided, on the day of the service.
– In electronic service vouchers, the user undertakes to confirm the
services in their personal space on the Sodexo website and at the latest,
within 3 days following the service. - The user will be billed the following amount (depending on the region of residence):
– €0.30/per service voucher in Brussels
– €0.90/ per service voucher in Flanders.
The invoice will be sent monthly to the user by email, or by mail at the express request of the user (+€2.50 additional for the cost of postal delivery).
This invoice is payable within 8 days of the date of sending and cannot be settled by means of service vouchers.
– In electronic service vouchers, the user undertakes to confirm the services in their personal space on the Sodexo website and at the latest, within 3 days following the service.
4. Services take place from Monday to Friday with the exception of public holidays, and can start from 08:00 and end at 18:00 maximum.
5. In the event of unforeseen absence of the domestic helper, TM Titres-Services company contacts the user to inform them and proposes a replacement, to the extent of service availability and with the user’s agreement.
6. Given the short timeframe requested for the planning and organization of these services, the user cannot cancel the requested service. Any one-off service cancelled will be billed to the user.
If the domestic helper cannot carry out her service at the user’s home due to the user’s absence or non-compliance with the access arrangements provided for in the contract, the user will be held responsible and the service will be due.
7. In the presence of surveillance cameras in the home, the customer must strictly comply with the regulations relating to the protection of privacy.
Article 2
1. The domestic helper is placed under the authority of TM Titres-Services company. If the user has a complaint to make, they must send an email to qualite@tmts.be
The user is required to notify of any absence, justified or not, of the domestic helper, and this as soon as it occurs.
2. The domestic helper is insured by TM Titres-Services company in case of work accident and on the way to work. She is also insured for civil liability for damage caused at the user’s home, under the conditions determined by the insurance company. The insurance company will determine the responsibility of the domestic helper in case of a claim.
Any claim or accident report must be made by email to the address sinistre@tmts.be within 48 hours to TM Titres-Services company. In case of acceptance of the claim, the damage will be repaired taking into account the wear and tear of the property. TM Titres-Services company is not legally and civilly responsible for criminal offenses committed by the domestic helper.
Article 3 : Conditions of execution
- The user undertakes to:
- Not require the domestic helper to perform any dangerous, too heavy, unsuitable work or work that violates basic hygiene rules;
- Inform in advance of the presence of animals in the home;
- Ensure that the equipment made available is in good working order and intended for household use, that detergents are labeled and in sufficient quantities and that a pair of household gloves are provided;
- Ensure that the work is carried out in conditions suitable from the point of view of the safety and health of the domestic helper;
- Pay the fixed amount determined by current regulations for all travel made at the request of the user for their personal shopping;
- Not have performed any activity other than that provided for by the legislation on service vouchers (article 1 of the Royal Decree of 12/12/2001 concerning service vouchers (Belgian Official Gazette December 22, 2001). Article 4 : End of the agreement
- This one-off services agreement requires no notice or compensation
- In case of non-compliance with this agreement by the user, and in particular in case of failure to provide service vouchers within the month of the service, TM Titres-Services company may ask the user to pay their service or services in “cash”.
- 3. In case of non-payment on the monthly due date (Service Vouchers and/or invoices), the user will furthermore be liable as of right and without prior notice to conventional interest at the rate of 12% per annum, any calendar month begun being due in full, as well as a fixed and irreducible conventional indemnity of 15% with a minimum of €125.
- The user is prohibited from working directly or indirectly with the domestic helper assigned to their service outside their collaboration with TM Titres-Services, for a period of 24 months. Any breach of this commitment will result in payment of a fixed indemnity of €4900, without prejudice to TM Titres-Services company’s right to claim compensation for actual damage.
- The agreement that unites the user with TM Titres-Services company is terminated as of right if there is no longer any issue of service vouchers.
- The validity, performance and interpretation of this agreement are exclusively governed by Belgian law.
- In case of disputes relating to the application of this agreement, both parties undertake to do everything possible to find an amicable solution.
- Any dispute between parties is subject to the exclusive jurisdiction of the Brussels Courts (Peace Court of Auderghem).
